Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Bonfire (“Bonfire,” “we,” “us,” or “our”). They cover the Bonfire mobile app (the “App”) and this website, including the waitlist (together, the “Services”). By creating an account, joining the waitlist, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy explains how we handle your information, including your voice recordings. Please read it together with these Terms.

1. Who can use Bonfire

You must be 13 or older (or the minimum age required in your country, if higher) to use Bonfire or create a Bonfire account. If you are 13 to 17, please review these Terms and our Privacy Policy with a parent or guardian, who must agree to them on your behalf. If we learn that an account belongs to someone under 13, we will delete it as described in the Privacy Policy.

You may not use the Services if we have previously banned you from them, or if using them would break the law where you live.

2. Your account

• Give accurate information when you sign up, including your age.
• Keep your login details secure. You are responsible for activity on your account, and should tell us right away if you think someone else is using it.
• One person per account. Don't share, sell, or transfer your account.
• You can delete your account at any time in the App's settings or by emailing hello@trybonfire.app.

3. What Bonfire does

Bonfire is a practice app for public speaking. You complete speaking exercises, the App records you, and, if you allow it, your recording is analyzed to give you scores and written feedback. You earn XP, levels, and streaks as you practice, and you can connect with friends to see each other's progress.

We are always improving Bonfire, so features may be added, changed, or removed over time. Some features may be limited or unavailable in certain regions or on certain devices.

4. Recordings, scores, and AI feedback

• Your permission comes first. Your recordings leave your phone for scoring only if you allow it in the App. You can still practice without allowing it; your exercises just won't be scored.
• Feedback is automated. Scores are calculated automatically and written feedback is generated by artificial intelligence. They may sometimes be inaccurate, incomplete, or miss context only a person would catch.
• Only record yourself. Record only your own voice, and don't capture other people without their permission.

5. Your content

You own what you create in Bonfire, including your recordings, the words you speak, and your profile details (“Your Content”). We don't claim ownership of it.

You give us a limited permission to store, copy, process, and transmit Your Content only as needed to run the Services for you — for example, to transcribe and score a recording, to generate feedback, and to show your display name and progress to friends you have connected with. This permission ends when Your Content is deleted from our systems, as described in the Privacy Policy. We do not use Your Content to train AI models, and we will not use your speech data to improve Bonfire unless you separately opt in.

You are responsible for Your Content, and you confirm that you have the right to share it with us.

6. Friends and other users

Friends you connect with can see your display name, username, and progress. Bonfire reserves the right to change any display name or username that we consider hateful, offensive, or otherwise problematic.

You can block anyone in the App. You can report an account by emailing hello@trybonfire.app; we review reports and may take action as described in Section 9.

7. Acceptable use

When using the Services, don't:

• Break the law or help someone else do so.
• Reverse engineer, copy, scrape, or resell the Services, except where the law expressly allows it.
• Interfere with or overload the Services, try to get around rate limits or security features, or access accounts or data that aren't yours.
• Use bots, scripts, or other automated means to use the App, earn XP or streaks, or submit the waitlist form.
• Use the Services to build a competing product, or to train or test AI models.

8. Subscriptions and purchases

Bonfire may offer paid subscriptions or other purchases in the App. If it does, the price and what you get will be shown before you buy. Purchases are made through the Apple App Store or Google Play and are handled under their terms, including billing, automatic renewal, cancellation, and refunds. You can manage or cancel a subscription in your App Store or Google Play account settings; deleting the App or your Bonfire account does not cancel it. Refund requests go to Apple or Google, except where the law requires otherwise.

9. Suspension and termination

You can stop using Bonfire and delete your account at any time. We may suspend or delete an account, or remove content, if it breaks these Terms, puts other users or Bonfire at risk, or if the law requires it. Where it is safe and practical, we will tell you first and give you a chance to respond — for example, when another user reports an account, we email its owner and give them 7 days to reply before we delete anything. Your responsibility for Your Content (Section 5) and Sections 10 through 15 continue to apply after your account ends.

10. Bonfire's property

The Services, including the App's design, exercises, scoring methods, text, graphics, logos, and the Bonfire name, belong to Bonfire or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, as allowed by these Terms. If you send us ideas or feedback, we may use them freely without owing you anything.

11. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Services will be uninterrupted or error-free, that scores or feedback will be accurate, or that using Bonfire will produce any particular result. Your recordings and reports are saved on your phone, and we are not responsible for losing them, including when you delete the App or change devices.

12. Limitation of liability

To the fullest extent the law allows, Bonfire will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or US$50.

Some places don't allow these limits, so they may not all apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

13. App store terms

If you downloaded the App from the Apple App Store or Google Play, these Terms are between you and Bonfire, not Apple or Google. Apple and Google are not responsible for the App, its maintenance or support, or any claims relating to it, including product liability, legal compliance, or intellectual property claims. If the App fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price (if any); Apple has no other warranty obligation. Your use of the App must also follow the app store's own usage rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. General

• Indemnity. If your misuse of the Services or breach of these Terms leads to a claim against Bonfire, you agree to cover the reasonable costs of that claim, to the extent the law allows.
• Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and Bonfire about the Services.
• Severability. If any part of these Terms can't be enforced, the rest still applies.
• No waiver. If we don't enforce part of these Terms right away, we can still enforce it later.
• Transfer. We may transfer these Terms as part of a merger, acquisition, or sale of assets. You may not transfer them without our permission.

15. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be resolved only in the state or federal courts located in North Carolina, and you and Bonfire agree to the jurisdiction of those courts. If you live outside the United States, you keep any protections that the consumer laws of your country give you and that cannot be waived.

16. Changes to these Terms

We may update these Terms as Bonfire changes. When we make material changes, we will update the date below and let you know in the App or by email before they take effect. If you keep using the Services after that, you accept the updated Terms. If you don't agree, you can delete your account.
